Your financial protection:
YOUR RESERVATION. The terms and conditions below apply to all fishing tour packages created using boombastic.sc. Please read the booking conditions carefully as they form the basis of your contract and set out our respective rights and responsibilities. When confirming your booking, we are entitled to assume that you have had the opportunity to read and have read these terms and conditions and have agreed to them. Reservations made by you or your travel agent on your behalf will be assigned a reservation number. Any monies paid by you to a travel agent are held by that travel agent on our behalf.
Once we have received your non-refundable tour deposit, we will send you a confirmation invoice confirming your tour details. It is then that a firm agreement is concluded between you and boombastic.sc in accordance with our Terms. This invoice will indicate the outstanding balance and the due date; no additional reminders will be sent. All offers are subject to availability at the time of booking.

PRICE GUARANTEE. We reserve the right to change prices at any time prior to booking confirmation. Once your confirmation invoice is issued, you will receive a guarantee excluding currency fluctuations, increased taxes and fuel surcharges. You will be notified of this increase immediately and your confirmation invoice will be updated accordingly.

WEBSITE DESCRIPTION. boombastic.sc has made every effort to compile our website accurately. Descriptions are based on the latest information at the time of publication. However, changes to the hotel/yacht/boat's amenities and descriptions may occur and we will make every effort to update the amenities and descriptions as soon as we become aware of such changes.

IF WE CHANGE YOUR TOUR - The programs we offer are planned months in advance and circumstances may change for a variety of reasons, so we reserve the right to change your tour at any time. If there are changes, most will be MINOR (see below) and we will inform you as soon as possible, subject to time remaining before departure. In the event of MAJOR CHANGES (see below) we will inform you at the earliest opportunity, provided there is time before departure, you will have the choice of: a) accepting the changed terms, b) agreeing to another holiday from us or c) Cancel the holiday with full.

A SMALL CHANGE is a change in aircraft, airline or departure time of a flight less than 12 hours, or a change or cancellation of services offered by the hotel. We believe that a MAJOR CHANGE is to change the departure airport to a different one from the original booking; departure or return time of more than twelve hours, but not flight delay, as this is covered by our insurance policy; replacement of housing of a lower category.

IF WE CANCEL YOUR TOUR - We reserve the right to cancel your tour. If we have to cancel your tour, we will refund any money you have paid or offer you an alternative tour of comparable quality. The above alternatives will not apply if cancellation by us is due to force majeure, non-payment or late payment of any part of the cost of your fishing tour or due to any changes requested by you within 4 weeks before departure when the cancellation fee will apply.

WHAT HAPPENS TO COMPLAINTS - In the unlikely event that you have a complaint during your tour, you will be asked to report it to our local representative who will endeavor to rectify the situation. If your complaint cannot be resolved locally, you must complete a form available from our local representative and send a copy to us within 10 days of your return along with your booking invoice number. We will respond to you within 28 days of receipt.

OUR RESPONSIBILITIES - We have taken all reasonable steps to ensure that the holidays and services we offer are of a reasonable standard. We take responsibility for the quality of your holiday. If any part is not provided as promised, we will pay appropriate compensation if the quality of your holiday is affected, but this does not apply in circumstances amounting to force majeure.

PERSONAL INJURY - (related to our arrangements) Boombastic Charters will indemnify our clients to the extent that they are entitled under Seychelles law in an Seychelles court for any personal injury, including illness or death, caused by the negligence of our agents, or our employees, contracted by us under contracted or sub-contracted as part of or in the course of their work in connection with your holiday (except for air, sea and rail carriages engaged in domestic, domestic or international transport where our liability will in all cases be limited in accordance with the relevant international convention) . Personal injury claims must be filed within 90 days of the incident, and if we make any payment to you, we reserve the right to seek any compensation from those responsible or suppliers. Therefore, by signing the booking form, you agree, in relation to yourself and any other persons for whom you are booking, that you assign to Boombastic Charters any rights against the supplier or any other person or party that you may have in connection with a claim, and You agree to cooperate fully with us if we or our insurers wish to enforce those rights that have been granted to us or to which we are subject.

INJURY - (Not related to our measures). If any client is injured, killed or becomes ill while on holiday abroad as a result of an activity that is not part of your tour, we will offer advice, guidance and assistance to assist you in resolving any claims you may have against to a third party. The parties provided that we are notified within 90 days of the incident. Any assistance we offer is limited to a maximum value of $5,000 per booking form. If you decide to take legal action against the responsible third party, and if the claim is successful, either from the third party or from a claim under the insurance policy, you must pay us the costs we incur in assisting you.

INTERNATIONAL CONVENTION. Liability for death, personal injury or illness is limited both in amount and in the time within which a claim must be brought. Our liability will not exceed any limitations applicable under any governing international convention, even if that convention has not been ratified.

NOT INCLUDED IN THE PRICE OF YOUR VACATION -

Travel between your home and your departure airport and vice versa, except for business and first class passengers on certain airlines.

Your holiday insurance.

Personal expenses such as porters, tips, telephone calls, extra food, etc.

Excursions unless stated to be included in the respective hotel.

Boombastic Charters will advise you of any additional taxes and fees as soon as possible.

Your confirmation invoice will be updated accordingly.

YOUR COMMITMENT TO SEYCHELLES TRAVEL

RESERVATION PAYMENTS. By asking Boombastic Charters to confirm your Seychelles tour booking, you agree to our Terms and Conditions on behalf of your entire group. You must send Boombastic Charters a non-refundable deposit of 50% from invoice amount. The balance must be paid no later than 4 weeks before first day of your tour. If payment is not received, we have the right to treat the booking as canceled and a cancellation fee will apply as described in section 4 below. Payment is accepted by bank transfer.

A contract will be concluded between us when you receive our confirmation invoice. When you book a vacation with Boombastic Charters, you are entering into a contract. The Booking Conditions and Insurance Conditions form the basis of this contract. Your agreement with us is made on these terms and conditions and is governed by Seychelles law for both parties, subject to the jurisdiction of the Seychelles courts.

TRAVEL INSURANCE. It is vital that everyone involved in your booking has adequate long-haul travel insurance, including repatriation, international and domestic flight delays, medical expenses, accidents, loss of luggage, death, valuables, cancellation or missed flight. If you travel without insurance, Boombastic Charters cannot accept any liability for expenses incurred that would otherwise be covered by insurance.

CHANGING YOUR RESERVATION. To make any changes to your booking, you must inform us in writing by the person who confirmed the holiday booking. There is a $150 fee for each reservation change.

CANCELLATION OF YOUR HOLIDAY. All cancellations must be notified to us in writing by the person making the booking. If you cancel your holiday more than 30 days before travel and have already paid for some of your holiday services, including international airfare, domestic Seychelles airfares, hotel deposits or yacht charter deposits, you will not be able to reimburse these costs. Upon receipt of your written refusal, the following fees will apply:
NOTE. If the reason for cancellation is covered by your insurance policy, you may be able to claim reimbursement for these costs.
IF YOU HAVE A PROBLEM. If you have a problem while on vacation, you will need to speak with your hotel manager or Boombastic Charters so they can resolve the issue. You should not wait until you return from your tour to complain, as then nothing can be done to resolve the problem. If your problem cannot be resolved and you wish to pursue the matter further, you must submit your complaint in writing to Boombastic Charters within 28 days of your return, quoting your holiday invoice number.
BEHAVIOR. If an airline or government agency refuses admission to someone on a flight or into a destination country, we are powerless to help and cannot be held responsible. Passengers who are considered to be under the influence of alcohol or drugs may be refused boarding or entry into the country. In these cases, we will assume that the person has given notice of cancellation and we will not be liable for any costs or fees incurred as a result of our actions.
